High Profile Women Judges and their Engagements
Quels engagements pour les magistrates de haut vol ?

In the UK even more than in France, the judiciary and, beyond that, the justice system, are still widely perceived as a male domain, if only through the impact of judicial decisions on society as a whole or through the links they have with the legislative and executive powers.
In this context of both vertical and horizontal segregation, it seems legitimate to ask what room for manoeuvre women who reach the highest echelons of the judiciary have in terms of engagement: have the obstacles they have had to overcome during their judicial career forced them to align themselves with the dominant male model and abandon any engagement related to their gender identity? Does the particular nature of their functions oblige them to a reserve that is incompatible with the forms that engagement usually takes?
We will attempt to consider the ways in which these women magistrates remain available by looking at two icons of diversity in the Anglo-Welsh judiciary, namely Linda Dobbs, the only black woman judge at High Court level, and Brenda Hale, the only woman to have reached the highest level of the judiciary, namely the UK Supreme Court.
Domaine d’action toujours largement perçu comme réservé au masculin, au Royaume-Uni bien plus encore qu’en France, la magistrature et, au-delà, la justice, font bel et bien partie du champ politique, ne serait-ce qu’à travers l’impact des décisions de justice sur la société dans son ensemble ou bien à travers les liens qu’elles possèdent avec le pouvoir législatif et exécutif.
Dans ce contexte de ségrégation à la fois verticale et horizontale, il semble légitime de se demander quelle marge de manœuvre possèdent les femmes qui parviennent aux plus hauts échelons de la magistrature en matière d’engagement : les obstacles qu’elles ont dû franchir au cours de leur carrière judiciaire les ont-elles contraintes à s’aligner sur le modèle masculin dominant et à abandonner tout engagement lié à leur identité de genre ? La nature particulière de leurs fonctions les astreint-elles à une réserve incompatible avec les formes que prend habituellement l’engagement ?
On tentera d’envisager les modalités qui restent disponibles à ces femmes magistrates en dressant le portrait de deux icônes de la diversité dans la magistrature anglo-galloise, à savoir Linda Dobbs, seule femme noire juge au niveau de la High Court et Brenda Hale, seule femme à avoir atteint l’échelon le plus élevé du système judiciaire, c’est-à-dire membre de la Supreme Court du Royaume-Uni.
